All eyes may be on Washington this month as the White House and Congress confront the fiscal cliff, but the industry that produces life-saving medications has recently gone over its own counterpart the patent cliff. That's the topic of the cover story in the current edition of Chemical & Engineering News (C&EN), the weekly newsmagazine of the American Chemical Society, the world's largest scientific society.

Rick Mullin, C&EN senior editor, explains that in the last 18 months, major pharmaceutical companies like Pfizer, Eli Lilly & Co. and AstraZeneca lost patents on some of their best-selling drugs. These included the anti-cholesterol medicine Lipitor, blood-thinner Plavix and schizophrenia drugs Zyprexa and Seroquel IR. In the U.S., patents on drugs last for 20 years, after which other companies are free to market generic versions. The loss of revenue combined with the global recession has sent manufacturers of such blockbuster medicines looking for better ways to develop new drugs.

Mullin describes how innovations are raising hopes for new drugs and profits as 2013 approaches. A cornerstone of the new approach is a focus on pairing low costs with high quality. The industry is also taking a fresh look at potential new drugs for Parkinson's, Alzheimer's and other unmet medical needs. In addition, drug companies are pursuing new research partnerships with universities, expanding their international markets, shrinking their staffs and buying up smaller biotechnology firms.

With a 5-1 win at Bemidji State on Friday night, the University of Minnesota women?s hockey team extended its road winning streak to 16 games, a new NCAA record. Megan Bozek and Amanda Kessel each contributed three points for the No. 1 Golden Gophers.

Both teams were scoreless through the first period and a half of action, but the Gophers grabbed the lead in the middle of the second. Minnesota had a 4-on-3 advantage when Bozek fired a shot that deflected off Becky Kortum. Hannah Brandt slapped the rebound into the back side of the goal to put the Gophers ahead 1-0 at the 10:22 mark. Bozek and Kortum were credited with assists.

Minnesota added a shorthanded goal at 12:03. Kessel had a breakaway down the right side of the net. Lee Stecklein got out of the penalty box and skated to the near post. Kessel passed the puck past a Bemidji State defender to Stecklein for a goal from just outside the crease.

The Gophers added a third goal in the period, with Kessel again playing a major role in the scoring opportunity. Bozek passed to Kessel, who skated toward the goal. She was tripped, but managed to pass the puck off of a Beaver player as she fell. Meghan Lorence backhanded it into the net for a 3-0 lead. Kessel and Bozek each had an assist.

Bozek blasted in a goal of her own from the blue line early in the third. Kessel and Lorence had the assists. Kortum made it 5-0 on a breakout right after a Gopher faceoff win later in the period. Rachel Ramsey and Stecklein were credited with assists.

The Beavers ended the shutout bid at 16:34 in the third with a Kristin Huber goal assisted by Natasha Kostenko. Minnesota goalie Noora R?ty stopped the other 27 Beaver shots on goal to pick up her 93rd career win.

With a win or a tie tomorrow, the Gophers would break the record for longest unbeaten streak in school history. They tied the record tonight by extending their streak to 26 games. The Gophers and Beavers will conclude this weekend?s series tomorrow at 4:07 p.m. at the Sanford Center.

(AP) ? Butch Jones wasn't Tennessee's first choice as its next football coach. The Volunteers believe the former Cincinnati coach will prove he's the right choice.

Tennessee announced Friday morning that Jones had agreed to become its fourth coach in six seasons, ending a tumultuous couple of days for both parties. Tennessee has scheduled a Friday afternoon news conference to announce the hiring, which was first reported by VolQuest.com.

"It is truly an honor and a privilege to be the head football coach at the University of Tennessee," Jones said in a statement. "I understand the values, traditions and level of expectations that come with this position, and I look forward to being a part of the Vol Nation."

Jones, 44, has a 50-27 record in six seasons as a head coach. He went 27-13 in three seasons at Central Michigan and was 23-14 at Cincinnati the last three years. He now faces the task of rebuilding a former Southeastern Conference power that has posted three consecutive losing seasons.

Tennessee went after at least two other candidates before hiring Jones.

During the 19-day search to replace Derek Dooley, who was fired Nov. 18 after going 15-21 in his three-year tenure, the Volunteers contacted ESPN analyst and former Super Bowl-winning coach Jon Gruden, who indicated he wasn't interested. The Vols then pursued Charlie Strong, who said Thursday he had turned down their offer and would stay at Louisville.

Jones, meanwhile, was apparently waiting for a job like Tennessee.

On the same day Strong made his announcement, Jones rejected an offer to take over Colorado's program. He also had been linked to the Purdue coaching job before withdrawing his name from consideration.

"I am very pleased that Butch Jones is the head football coach at Tennessee," athletic director Dave Hart said in a school release. "Butch has a track record of success at every program he has led, and he views Tennessee as the job he coveted. We look forward to Butch leading our football program back to prominence."

Jones' hiring means each of the four Southeastern Conference teams that fired coaches this year has filled their vacancies.

Kentucky hired Florida State defensive coordinator Mark Stoops last week to replace Joker Phillips. Arkansas hired Bret Bielema away from Wisconsin on Tuesday to take over for John L. Smith. Auburn selected Arkansas State's Gus Malzahn on Tuesday as the replacement for Gene Chizik.

Jones will be Tennessee's fourth coach in a six-season stretch, not including offensive coordinator Jim Chaney's stint as interim head coach in the 2012 season finale after Dooley's dismissal. Phillip Fulmer was fired after the 2008 season, ending his career with a 152-52 record at Tennessee. Lane Kiffin coached Tennessee in 2009 before leaving for Southern California. Dooley lasted three years.

After winning at least eight games for 16 consecutive seasons from 1989-2004 and posting double-digit wins in nine of those years, Tennessee hasn't earned more than seven victories in any of its last five seasons. The Vols went 5-7 this fall for their fifth losing season over the last eight years. This also is the first time since 1909-11 that Tennessee has finished below .500 three years in a row.

Hart said at the start of the search that head coaching experience was "critically important" and that he wanted a coach who "knows the difficulty of climbing the ladder in the SEC." Jones lacks SEC experience, but he has a career winning percentage of .649. Jones' teams have earned at least a share of a conference title in four of his six seasons as a head coach.

After replacing Notre Dame coach Brian Kelly at Central Michigan and then again at Cincinnati, Jones maintained the momentum his predecessor had established at each school.

In Jones' three-year stint at Central Michigan, the Chippewas won two Mid-American Conference championships and posted a combined league record of 22-3. Jones went 4-8 in his first year at Cincinnati, but the Bearcats are 19-6 since and have tied for first place in the Big East each of the last two seasons. Cincinnati's 2011 season included a 45-23 loss at Tennessee.

Jones signed a contract extension after the 2011 season that includes a $1.4 million buyout if he left before Jan. 1. Cincinnati has made defensive line coach Steve Stripling its interim head coach for the Dec. 27 Belk Bowl against Duke in Charlotte, N.C., while it begins searching for Jones' successor.

"There is no timetable to make the hire," Cincinnati athletic director Whit Babcock said Friday. "Making the right hire is better than the quickest hire, but admittedly sooner is better if possible."

Jones' background as an assistant is entirely on offense, but one of his biggest challenges at Tennessee initially will be strengthening a defense that allowed the most points (35.7) and yards (471.4) per game of any SEC team this season. The Vols hadn't allowed that high a scoring average since 1893, when they gave up 42.7 points per game while playing a six-game schedule. They hadn't yielded that many yards per game since at least 1950, the earliest year Tennessee's sports information department has that statistic on file.

The makeup of Jones' first offense at Tennessee also remains uncertain, at least for now.

Starting quarterback Tyler Bray and star wide receivers Cordarrelle Patterson and Justin Hunter all are projected as first- or second-round draft picks if they choose to turn pro rather than returning to school for their senior seasons. Bray threw for 3,612 yards and 34 touchdowns this year to rank second on Tennessee's single-season list in both categories, behind Peyton Manning's 3,819 yards and 36 touchdown passes in 1997. Hunter caught 73 passes for 1,083 yards and nine touchdowns. Patterson gained a school-record 1,858 all-purpose yards.

Junior offensive tackle Ja'Wuan James also has been mentioned as a possible draft candidate.

(AP) ? In a reversal of roles, Kobe Bryant and the Los Angeles Lakers know they're the predators trying to track down Kevin Durant's Oklahoma City Thunder.

They have some work to do.

Durant had 36 points, Russell Westbrook scored 27 of his 33 in the first half to stake Oklahoma City to a commanding lead and the Thunder beat the short-handed Lakers 114-108 Friday night.

"They're a team that everybody likes. As a young team coming up, you always want to beat the best," Westbrook said. "I think that's one of the things that motivates us."

Bryant had 35 points for Los Angeles, which trailed by as many as 19 before rallying to get within four in the final minute.

Dwight Howard added 23 points and 18 rebounds for the Lakers, who were eliminated by the Thunder in five games in last season's Western Conference semifinals. Howard and Steve Nash were part of an offseason overhaul to try and catch up to the Thunder.

Instead, the Lakers are 9-11 and focusing on small gains that give them the belief they'll eventually turn it around.

"It's 82 games. This team has just gotten together," Howard said. "It's not like we're going to get together and start winning right away. ... We're learning how to play together. We're getting better. This is not on anybody's time table but ours."

Westbrook's big first half put the Thunder in control, but L.A. charged back with a late 27-12 run to make it interesting.

The game grew tense when Metta World Peace ? already a public enemy in Oklahoma City after he clocked James Harden last season ? and Serge Ibaka each got technical fouls for a confrontation in the closing minutes.

World Peace grabbed Ibaka's back and the two barked at each other face to face and chest to chest, with Ibaka then grasping the back of World Peace's jersey. Ibaka rared back with his right fist clenched, but the two were separated before it escalated any further.

"It's always like that with us, especially Metta World Peace and Serge," Durant said. "Those guys are just playing hard. I don't think it was nothing malicious or bad plays, just guys playing hard."

The Lakers never backed down. After trailing by 12 with 1:32 remaining, Jodie Meeks drove for a pair of layups and Chris Duhon followed with a 3-pointer to cut the deficit to 110-105. Bryant followed Durant's two free throws with a 3-pointer from the corner to get the deficit down to four with 15 seconds left.

Durant hit two foul shots and Meeks airballed a 3-pointer as the rally fizzled.

"They're a tough team," Durant said. "They fought hard all night and made it tough on us."

That it even ended up so close was a surprise after how the first half went, with Westbrook red hot and Oklahoma City outscoring L.A. 26-8 in fast-break points on its way to a 14-point lead.

Westbrook was in attack mode right from the start with Los Angeles missing top point guards Nash (left leg) and Steve Blake (abdominal surgery), plus All-Star forward Pau Gasol for the third straight game with tendinitis in both knees. Westbrook buried 3-pointers on two of Oklahoma City's first three possessions on his way to making a career-best five from behind the arc ? all in the first half.

"That's as good as I've seen him shoot the ball," Bryant said.

When Westbrook missed his first eight shots of the second half, Durant helped pick up the slack. He made a jumper, a 3-pointer and a runner for a personal 7-0 run that increased Oklahoma City's edge to 85-66 with 3:34 left in the third quarter.

That 19-point cushion was restored with 7:42 left in the game when Nick Collison took a charge at one end and then dunked at the other to make it 100-81. The Lakers didn't have quite enough to come back.

"We all know that the Lakers are one of the best teams," Oklahoma City coach Scott Brooks said. "They don't have the record right now but they will. They're going to get some guys healthy and they're going to get some rhythm but they have the best center in basketball and they have one of the best players ever."

That still wasn't enough.

The Thunder charged ahead in the second quarter, just as they'd done in each of their previous five games ? outscoring opponents by 55 points in the period during that span.

After directing a 10-0 run earlier in the quarter, Westbrook connected on back-to-back jumpers from the right elbow and assisted on Ibaka's jumper before making a 3 from the left wing.

To top it all off, he made his fifth 3-pointer while getting fouled by Duhon ? then still went ahead with his usual celebration move of acting as though he were holstering his hands even while lying on his back.

NOTES: Howard spent time near the end of the Lakers' shootaround practicing his free throws, with Nash ? a 90-percent foul shooter in his career ? offering suggestions and even mimicking a follow through. At one point, Howard made eight in a row. "My mind cannot get clouded with everybody telling me how to shoot a free throw," said Howard, who's shooting 47 percent at the line this season. "I just have to go up there and shoot it my way and not get caught up with what everybody else is saying because that's when I miss." ... The Lakers went to see the movie "Lincoln" on their day off Thursday. Bryant joked that he didn't know what was taught in school anymore and some of his teammates might not have known Abraham Lincoln's story. "I'm curious to see if you took a poll who knew," Bryant said. "Maybe it came as a great shock to them that Lincoln died at the end of the film." ... Bryant didn't argue when told that Durant called him an "old fart." He said he calls Durant "Similac," a brand of baby formula. ... Oklahoma City recalled Daniel Orton, Jeremy Lamb and Perry Jones III from Tulsa of the NBA development league. Jones was on crutches with a sprained left ankle the team referred to as mild.

NEWARK, N.J. (AP) -- NBA Commissioner David Stern scolded Gov. Christie and said New Jersey "has no idea what it's doing" by seeking to allow sports betting in the state in a deposition published Friday in the ongoing legal battle between the governor, the four major professional sports leagues and the NCAA.

Stern and the heads of Major League Baseball, the NFL, the NHL and the NCAA were questioned recently by lawyers representing the state as part of the leagues' lawsuit seeking to stop New Jersey from instituting sports gambling.

"The one thing I'm certain of is New Jersey has no idea what it's doing and doesn't care because all it's interested in is making a buck or two, and they don't care that it's at our potential loss," Stern said when asked how the advent of sports betting in New Jersey would harm the NBA.

"And wholly apart from the fact that a governor, who's a former U.S. Attorney, has chosen to attack a federal law which causes me pause for completely different reasons since I've at times sworn to similar oaths about upholding the law of the United States," Stern continued.

MLB commissioner Bud Selig said in his deposition he was "appalled" that New Jersey would look to sports gambling as a fiscal solution.

"I know states need money. I really mean that," he said. "I understand all the problems. Federal government needs money, going over a cliff, cities need money. Chris Christie needs money. But gambling is so ... the threat of gambling and to create more threat is to me - I'm stunned. I know that people need sources of revenue, but you can't - this is corruption in my opinion.

"I have to say to you I'm appalled. I'm really appalled."

A spokesman for Christie didn't immediately return a message seeking comment Friday.

The leagues and the NCAA sued Christie in August after he vowed to defy a federal ban on sports wagering. The Legislature enacted a sports betting law in January, limiting bets to the Atlantic City casinos and the state's horse racing tracks. The state plans to license sports betting as soon as January, and in October published regulations governing licenses.

A judge is expected to rule this month on the leagues' motion for an injunction to stop the law from taking effect.

In his deposition, NFL Commissioner Roger Goodell was asked about holding games in England and Canada, countries with legalized sports gambling. The leagues contend allowing New Jersey to sanction sports gambling would damage their integrity.

"Well, we're playing in their country, we're coming to them," Goodell responded. "And we're only there for a short period of time; we're there for two or three days. It's not what we choose, it's not what we believe is in the best interests of sports, but we don't dictate the rules or the laws."

NHL commissioner Gary Bettman said the fact that New Jersey's law exempts the state's colleges and any college games played in the state shows that lawmakers recognize gambling "isn't good for our game." He sounded confident when asked if the NHL had contemplated any changes to its policies should New Jersey's law stand.

"Not to sound flip on this point but it's inconceivable to me how we could lose this lawsuit, so we haven't been doing that," he said.

New Jersey's move is seen by supporters as a way to bring new revenue to the struggling casino and racing industries and to reclaim a portion of the billions of untaxed dollars flowing to organized crime or offshore illegal gambling operations.

But in its court filing Friday opposing the state's motion to dismiss the lawsuit, the leagues and the NCAA called Christie's efforts a "blatant violation of federal law" and his constitutional challenges to the federal law "specious."

The 20-year-old federal law at the heart of the dispute, the Professional and Amateur Sports Protection Act, prohibited states from authorizing sports gambling, but exempted Nevada and three other states that already had some form of legalized sports betting - Delaware, Oregon and Montana.

New Jersey claims the law usurps the authority of state legislatures and discriminates by "grandfathering" in some states. The leagues countered Friday that Congress has the power to prevent states from enacting laws that conflict with federal policy, and that the Constitution's commerce clause doesn't require uniformity in its application to different states.

The NCAA has already announced it will relocate several championship events scheduled to be held in New Jersey next year.

An Elitistreview book? - Elitistreview

I started writing a book at the beginning of summer; about Burgundy, oddly. Much as I enjoy writing it is a lot of effort for mad man me. Consequently, it occurs to me I should find out whether anyone would actually be interested in buying it before flaying myself alive writing the bloody thing. Hence this poll.

SONY DSC My book is called 50 Great Burgundies and it is an unhinged hurtle through what I consider the 50 Burgundies most entitled to leave you in penury. They are not all the famous crus from exalted producers, but the kind of things I seek out because they?re available, attractive and (almost) affordable.

For each of the fifty wines I recommend I?m writing a general style guide and a more detailed analysis of a vintage I feel particularly successful. Again my chosen vintages might be be the ones received wisdom would lead you to expect. I also give general notes about the producer, and there may be more than one wine per producer.

I was planning to publish this as an Amazon/Kindle eBook, because everyone can read them on their smartphones, tablets, computers, etc. and I doubt anyone would dare publish me in book form. It?d be a couple of hundred pages long with a sprinkling of unobtrusive pictures to break up my screaming rants. It would be quite cheap.

So, my question: Would you be interested in buying an Elitistreview book?

Galleries spite Sandy to show at Art Basel Miami

(AP) ? It's art season in the Miami area.

Art Basel Miami Beach and about two dozen other independent art fairs open Thursday. Tens of thousands of people are expected through Sunday at the fairs throughout Miami and South Beach.

The international art fair is an offshoot of a big European festival, Art Basel in Switzerland. It runs through Sunday.

Art Basel officials say Superstorm Sandy almost kept some New York City galleries from participating this year. About 20 percent of the 257 galleries showing work in Art Basel Miami Beach's main hall are from New York's hard-hit Chelsea gallery district.

Art Basel director Marc Spiegler says some of the Chelsea galleries just had minor water damage. Others lost everything they had in storage. However, none chose to skip the prestigious contemporary art fair.

Matt Sayles / AP

Hugh Hefner and Crystal Harris in 2010.

By Peter Gicas, E! Online

It looks like Hugh Hefner and Crystal Harris really are planning on tying the knot, after all.?That's because the Playboy founder and his once-again fiancee obtained a marriage license on Tuesday, E! News confirms.

Although, such news won't come as too much of a surprise to some USC students.

Hugh and Crystal reunite

It seems Hefner was actually a guest speaker at the Los Angeles university's "Censorship in Cinema" class today. While in the classroom, along with Harris, he happily revealed the couple's plans for later in the afternoon.

Here are some other celeb weddings we can't wait for

USC senior Heather Ritchie told E! News that Hefner began his guest talk by saying, "Today is a special day for us because after class, we are going to the courthouse to get our marriage license."

Talk about a scoop!

A Beginner's Guide to manage 401k Investments

7437997836 6a4b9c0502 A Beginners Guide to manage 401k Investments

Pension plans are slowly becoming a thing of the past. If you?re looking for good investments which have tax advantages, think about the 401k. 401k comes from the IRS retirement account that goes by the same number and here?s a beginners guide to manage 401k investments.

Choose how much you want to set aside each month for your 401k investment. Ideally, it should be at least 10% of what you make, but the more you can save, the better it is for you. Remember, it is for a time when you can actually sit back and relax, so don?t be unhappy if you?ve had to give up a holiday for the 401k. If you don?t want to think about this, set up an automatic fund transfer and forget about it.

Remember you want your investments to grow tax free. The 401k is offered by private businesses and one of its biggest benefits is the tax benefit. This of it as a retirement account where the company you work for, deducts an amount from your paycheck as an investment in your 401k account. This money is not taxed till you make a withdrawal when you retire, which is good news indeed. Your money grows but you?re not taxed for it till much later.

Choose your investments carefully. Your company will be able to help you out here, bringing in expert advice or investment options for you to consider. You might not have a lot to choose from, but mutual funds will most likely be on the menu. Do your homework before you choose where you want to put your 401k.

See what your company has to offer. Companies offer their own money for every little amount you contribute. The company contribution for a $1, for instance could be anywhere between 50 cents to a dollar. So do see what the company policy is and then decide how you want to proceed, both in terms of what you want to contribute and where you want to invest.

The 401kinvestment plan is ready for withdrawal when you?re a few months shy of sixty or if you?ve let your place of work at the age of 55. Any time before, and you could attract a 10% penalty apart from the income tax you?ll have to pay. So bide your time, be patient and wait for your money to grow.

But you can still make the 401k work for you- take a loan on the amount you?ve invested in the 401k. You will need to follow company policy on this but you should be able to borrow about half of the money you?ve put in and have about five years to pay it all back. In the case of an emergency, this may seem like a tempting idea, but if you can, hold off on the borrowing as well.

What happens if you quit this job? You have an option of taking your 401k and rolling it over, tax free, to an IRA rollover, a retirement account. There are many ways to plan for a rainy day and the 401k is one of the best ways to do so.

State governors to meet with Obama, Boehner on "fiscal cliff"

WASHINGTON (Reuters) - With a few weeks remaining before the onset of "fiscal cliff," a bipartisan delegation of governors is set to meet Tuesday with President Barack Obama and congressional leaders in search of some answers about the impact of deficit reduction measures on their state budgets, which rely heavily on federal aid.

Federal grants to the states comprise about a third of state revenues in the United States, according to the Pew Center on the States.

Cutbacks in federal contracting due to the automatic budget cuts set for January 1 will also reduce employment levels regionally, with the heaviest impact expected in areas with large numbers of defense contractors.

The governors making the rounds Tuesday, who hold leadership positions in the National Governors Association, are Democrats Jack Markell of Delaware, Mark Dayton of Minnesota and Mike Beebe of Arkansas and Republican Gary Herbert of Utah, Scott Walker of Wisconsin and Mary Fallin of Oklahoma.

The so-called fiscal cliff refers to combination of government spending cuts and tax rises due to be implemented under existing law starting New Year's Day that may cut the federal budget deficit but also tip the economy back into recession.

But with Republicans and Democrats still in preliminary stages of negotiations over how to avoid the steep tax hikes and spending cuts set for the end of the year, these NGA leaders may leave frustrated, as have numerous other delegations of civic, union and business leaders trooping to Washington in the past few months.

Republicans proposed steep spending cuts on Monday but gave no ground on Obama's call to raise taxes on the wealthiest in their first formal proposal to avert the fiscal cliff.

The White House dismissed the Republican proposal within an hour of its being made public, the same treatment Republicans gave Obama's deficit reduction plan last week.

While the offers and counteroffers between Republicans and Democrats may ultimately create the conditions for actually getting in a room together and bargaining at length, so far the moves have been out in public and mostly for show.

It's "just a Kabuki theater you go through" so far, Erskine Bowles said in an interview Monday evening on PBS' "Newshour." Bowles was co-chair with former U.S. Sen. Alan Simpson of a deficit reduction commission widely praised for its recommendations two years ago but never accepted by either party.

"They're going to have to get together at some point in time when the time is right in a conference room and go through these three big items," Bowles said.

That theater is likely to continue Tuesday when Democrats in the House of Representatives begin an effort to force a vote on tax hikes on the wealthy, over the objections of the Republican-controlled House, which is not expected to bring a bill to the floor until a bargain is struck.

Under House rules, the minority Democrats would need about 26 Republican votes to succeed with their "discharge petition," and the process takes so long that it would likely be weeks before a vote would actually take place.

"We just don't know what Washington's going to do," Oklahoma Gov. Mary Fallin told The Oklahoman on the eve of her departure for Washington

The city is now awash in competing plans to cut the exploding Federal deficit.

A think tank with ties to the Obama administration laid out another one Tuesday, urging the president to go bold and seek more concessions from Republicans on tax hikes.

The $4.1 trillion deficit-cutting plan from the Center for American Progress seeks $1.8 trillion in new revenue, compared with Obama's call to raise $1.6 trillion.

It also calls for a 28 percent tax on capital gains income for high earners, whereas Obama has called for about a 24 percent tax rate, including new taxes from the healthcare overhaul.

Disney Loses Appeal in $319 million "Who Wants to Be a Millionaire" Case

LOS ANGELES (TheWrap.com) - The Walt Disney Company has lost its bid for a new trial in its legal saga with the creators of the game show "Who Wants to Be A Millionaire?" who won a $319 million award against the company in 2010.

In a ruling filed on Monday, a trio of U.S. 9th Circuit Court of Appeals judges shot down ABC, Buena Vista Television and Valleycrest Productions, after those companies (referred to as "the Disney affiliates" in the ruling) sought to appeal an earlier order denying their motion for judgment as a matter of law, and for a new trial in the matter.

In 2010, "Millionaire" creators Celador International, Inc. received a judgment of just over $269 million, and the company later received another $50 million after Judge Virginia Phillips awarded prejudgment interest to the British company.

Celador, which initially filed suit in 2004, had argued that Disney and its affiliates ABC, Buena Vista Television and Valleycrest Production set up numerous shady deals and on-the-sly arrangements that robbed Celador of hundreds of millions in expected revenues.

Disney lost a bid to overturn the jury's verdict in December 2010, but argued in its motion in the 9th Circuit that the U.S. District Court in Central California had "committed evidentiary, instructional and other errors."

The 9th Circuit judges disagreed, upholding the award.

A spokeswoman for ABC did not respond to TheWrap's request for comment.

Third storm in less than week drenches Northern Calif.

SAN FRANCISCO (AP) ? Residents of Northern California endured the brunt of another powerful storm that drenched the area with yet another round of pounding rain and strong winds, but damage from the storm was less than expected, officials said.

The latest storm system ? the third to hit the area in less than a week ? moved across the region late Saturday and early Sunday dropping as much as an inch of rain per hour in some areas, toppling trees and knocking out electrical service to tens of thousands of people, officials said.

Rivers across Northern California swelled from the deluge, but did not flood as extensively as had been expected, officials said.

Forecasters had issued flood warnings for the Napa and Russian rivers, two rivers north of San Francisco with a history of flooding, as well as the Truckee River, near Lake Tahoe, but by Sunday afternoon had canceled the warning for the Russian River.

"It (the storm) moved through a lit bit faster than it was looking like it would, so it didn't plant on top of us and keeping raining," said Austin Cross, a meteorologist with the National Weather Service. "The period of heavy rain didn't last as long."

In Napa, where officials had handed out more than 8,000 sandbags and about 150 tons of sand before the storm hit, officials breathed a sigh of relief Sunday afternoon after the heaviest rain moved out of the area and the city appeared to avoid any major damage from the storm.

"We've had some minor street flooding and some of the intersections were flooded," Napa city spokesman Barry Martin said.

Flood construction projects were credited with keeping the river within its banks through the city, while most of anticipated flooding, expected around 6 p.m. Sunday, was expected to hit a mostly agricultural area outside of the city, officials said.

In Truckee, 30 miles west of Reno, city officials were focusing on snow removal Sunday afternoon instead of flood control after the town received 4 to 5 inches of snow in the morning, said Assistant City Manager Alex Terrazas.

"We continue to keep an eye on the river, but things are certainly better than they could have been," he said. "We'll transition back to flood management if we need to."

Besides the speed in which the system moved through the area, weather officials were heartened by colder temperatures than expected in the mountains, meaning more snow and less rain fell.

In far Northern California, flood warnings remained in effect Sunday for the Eel, Navarro and Mad rivers.

Meanwhile, as Pacific Gas & Electric crews worked on restoring power, about 57,000 people from Santa Cruz to Eureka, including about 13,000 people in the San Francisco Bay area, remained without electricity Sunday afternoon as the powerful winds from the storm knocked down trees and sent broken tree limbs and branches across power lines, officials said.

"It really did broadside California," PG&E spokesman Joe Molica said of the storm.

About 2,000 PG&E crews were working Sunday to try to restore power, Molica said.

Wind gusts, recorded as high as 60 miles per hour in parts of the Bay area, were blamed for knocking over a big rig truck as it drove over the Richmond-San Rafael Bridge at around 5 a.m. Sunday.

Tow crews had to wait for the winds to subside later in the morning before they could remove the truck, officials said.

Also, train service on the Bay Area Rapid Transit system was disrupted for about an hour Sunday morning because of an electrical outage blamed on the weather.

Tumblr Hacked - Business Insider

UPDATE: According to a tweet by Mashable reporter Alex Fitzpatrick, Tumblr is operational again.

In an interview with Gawker, the group responsible for the hack says they warned Tumblr about the exploit weeks ahead of time.

PREVIOUSLY: Tumblr has been hacked.

Check out the Daily Dot's Tumblr page to see what's going on, but be careful ? if you visit a hacked page while logged in to Tumblr, your account will be compromised as well.

The worm takes over a Tumblr blog and turns every post into an angsty anti-Tumblr message, railing against the "pandemic growth and world-wide propagation of the most f*cking worthless, contrived, bourgeoisie, self-congratulating, and decadent bullsh*t the internet has ever had the misfortune of facilitating."

It includes a warning that attempting to delete the altered posts will delete your entire Tumblr account. This doesn't seem to be the case, as Buzzfeed points out that you can delete the posts using Tumblr's Mega-Editor.

If you absolutely must check Tumblr right now, do so through your Dashboard and don't visit links to Tumblr pages. You can also log out to visit Tumblr without being affected.

The group claiming responsibility is the GNAA, an group of anti-blogging internet trolls. The acronym stands for something pretty unpleasant. Check out the Wikipedia page to learn a bit more about them.

The group's Twitter account claims that 8,600 blogs have been affected so far.

We reached out to Tumblr for comment, which provided us with the following response:

"There is a viral post circulating on Tumblr which begins "Dearest 'Tumblr' users". If you have viewed this post, please log out of all browsers that may be using Tumblr immediately. Our engineers are working to resolve the issue as swiftly as possible.? Thank you."

Buzzfeed offers the following as to how the hack was made possible: "One developer suggests that the exploit uses a 'data-uri script tag' in the video embed field. In other words, it runs some sort of script through the section of the site that's supposed to only allow video embed codes from sites like YouTube and Vimeo. A pretty serious security hole!"

(AP Photo/Ed Zurga, File)

(AP) ? It began like any other Saturday for the Kansas City Chiefs during the NFL season, their general manager and coach at work early to put final touches on this weekend's gameplan. Then they got a call to hurry to the parking lot.

The two men rushed through the glass doors of Chiefs headquarters and came face-to-face with linebacker Jovan Belcher, holding a handgun to his head.

Belcher had already killed his girlfriend and sped the short distance to Arrowhead Stadium, right past a security checkpoint guarding the entrance. Upon finding his bosses, Belcher thanked general manager Scott Pioli and head coach Romeo Crennel for giving him a chance in the NFL. Then he turned away and pulled the trigger.

The murder-suicide shocked a franchise that has been dealing with controversies now made trivial by comparison: eight consecutive losses, injuries too numerous to count, discontent among fans and the prospect that Pioli and Crennel could be fired at season's end.

Authorities did not release a possible motive while piecing together the case, other than to note that Belcher and his girlfriend, 22-year-old Kasandra M. Perkins, had been arguing frequently.

The two of them left behind a 3-month-old girl. She was being cared for by family.

The Chiefs issued a statement that said their game Sunday afternoon against the Carolina Panthers would go on as scheduled, even as the franchise tried to come to grips with the awfulness of Belcher's death.

"The entire Chiefs family is deeply saddened by today's events, and our collective hearts are heavy with sympathy, thoughts and prayers for the families and friends affected by this unthinkable tragedy," Chiefs chairman Clark Hunt said in brief a statement.

A spokesman for the team told The Associated Press that Crennel plans to coach on Sunday.

"I can tell you that you have absolutely no idea what it's like to see someone kill themselves," said Kansas City Mayor Sly James, who spoke to Pioli shortly after the shootings.

"You can take your worst nightmare and put someone you know and love in that situation, and give them a gun and stand three feet away and watch them kill themselves. That's what it's like," James said. "It's unfathomable."

Chiefs quarterback Brady Quinn told The Kansas City Star that when the team met later Saturday morning, Crennel broke the news to them.

"It was obviously tough for coach to have to tell us that," Quinn said. "He really wasn't able to finish talking to us. We got together and prayed and then we moved on."

But Quinn said the team was so stunned, it was hard to digest what had happened.

"It's hard mostly because I keep thinking about what I could have done to stop this," he said. "I think everyone is wondering whether we would have done something to prevent this from happening."

The 25-year-old Belcher was from West Babylon, N.Y., and played college football at Maine. He signed with the Chiefs as an undrafted free agent, made the team and hung around the past four years, eventually moving into the starting lineup. He played in all 11 games this season.

The NFL released a statement expressing sympathy and pledging "to provide assistance in any way that we can." The players' association has also been in touch with members of the Chiefs.

"We sincerely appreciate the expressions of sympathy and support we have received from so many in the Kansas City and NFL communities, and ask for continued prayers for the loved ones of those impacted," Hunt said. "We will continue to fully cooperate with the authorities and work to ensure that the appropriate counseling resources are available to all members of the organization."

The drama unfolded early Saturday when authorities received a call from a woman who said her daughter had been shot multiple times at a residence about five miles from the Arrowhead complex. The call came from Belcher's mother, who referred to the victim as her daughter.

"She treated Kasandra like a daughter," Kansas City police spokesman Darin Snapp said, adding that the woman had recently moved in with the couple, "probably to help out with the baby."

Police then got a phone call from the Chiefs' training facility, and Belcher's description matched the suspect description from the initial address. Snapp said officers pulled into the practice facility parking lot in a matter of minutes, in time to witness the suicide.

"Pioli and Crennel and another coach or employee was standing outside and appeared to be talking to him," Snapp said. "The suspect began to walk in the opposite direction of the coaches and the officers and that's when they heard the gunshot. It appears he took his own life."

The coaches told police they never felt in any danger.

"They said the player was actually thanking them for everything they'd done for him," Snapp said. "He was thanking them and everything. That's when he walked away and shot himself."

Members of the Chiefs mostly laid low Saturday, but a few reacted on Twitter.

"I am devastated by this mornings events," Pro Bowl linebacker Tamba Hali wrote. "I want to send my thoughts and prayers out to everyone effected by this tragedy."

A large group of Belcher's friends and relatives gathered Saturday at his boyhood home on Long Island.

His family turned the front yard into a shrine, with a large poster of Belcher, an array of his trophies, and jerseys and jackets from Kansas City, Maine and West Babylon High.

"He was a good, good person ... a family man. A loving guy," said family friend Ruben Marshall, who said he coached Belcher in youth football. "You couldn't be around a better person."

At least 20 people gathered for a large group hug in the driveway.

"He was a tremendous player and all those things, and his accolades speak for themselves, but he lit up when he spoke about his mom, or when he hugged his family after games," said Dwayne Wilmot, who was Belcher's position coach at Maine and is now an assistant coach at Yale.

"It's difficult to talk about Jovan in the past tense," he told the AP. "There's going to be unanswered questions, the why's of this tragedy. It'll never be truly known to us."

Wilmot said he'd stayed in touch with Belcher the past few years through social media.

"He was someone who took genuine pleasure in bringing happiness to others," Wilmot said. "I was so excited when he became a father, because I knew he'd be a great father."

His girlfriend's Facebook page shows the couple smiling and holding the baby.

Belcher is the latest among several players and NFL retirees to die from self-inflicted gunshot wounds during the past few years. The death of star linebacker Junior Seau, who shot himself in the chest in at his California home last May, sent shockwaves around the league.

Seau's family, like those of other suicide victims, donated his brain tissue to medical authorities to determine if head injuries he sustained playing football might be linked to his death. That report has not been released, although an autopsy showed no underlying hemorrhaging or bruises on Seau's brain.

Belcher did not have an extensive injury history, though he was listed as having a head injury on a report from Nov. 11, 2009. Belcher played four days later against the Oakland Raiders.

Earlier this year, the NFL provided a grant to help establish an independently operated phone service that connects players, coaches, team officials and other staff with counselors trained to work through personal and emotional crises. The NFL Life Line is available 24 hours a day.

The season has been a massive disappointment for the Chiefs, who were expected to contend for the AFC West title. They're 1-10 and mired in an eight-game skid marked by injuries, poor play and fan upheaval. During the past few weeks there have been constant calls for Pioli and Crennel to be fired.

It's unknown how the Chiefs plan to pay tribute to Belcher during Sunday's game.

"His move to the NFL was in keeping with his dreams," said Jack Cosgrove, who coached Belcher at Maine. "This is an indescribably horrible tragedy."
